Right of withdrawal

Naturally we give the right of withdrawal for customers in distance trading according to German Civil Code (§ 13 BGB).

You may withdraw your contractual acceptance in writing (e.g. by letter, fax or email) within two weeks without stating grounds, or - if the item is placed at your disposal prior to the expiry of this period - by returning the item. The period begins upon receipt of this notification in writing, but not before receipt of the goods at the receiver (in the recurring supply of similar goods before receipt of the first partial delivery) and also not meeting our information requirements pursuant to art. 246 § 2 in conjunction with § 1 para. 1 and 2 EGBGB as well as our obligations under § 312e para.1 sentence 1 in conjunction with art. 246 § 3 EGBGB. In order to meet the ervocation deadline it is sufficient to dispatch the revocation or goods in time. The revocation must be sent to:

Consequences of withdrawal

In the event of effective revocation, the services received by either party shall be returned and any benefits that may have been accrued shall be released. If you can not return the received services to us, or if you can return the services only in part or in deteriorated condition, you may have to compensate us accordingly. This does not apply if the relevant impairment of the goods is due to the simple trial use of the product, which the customer would have reasonably been able to conduct in a store. For the rest, you may avoid any duty to provide compensation for any deterioration of the goods caused by the intended use, by not using the goods as your own property and refraining from all actions that may affect its value. Goods which can be sent by parcel shipment are to be returned at our risk. You have to bear the costs of the return if the deliverd goods conform with the ordered one's and if the price of the returning goods do not exceed an amount of 40,00 Euros. You also have to pay for the return although the price exceeds 40,00 Euros, when you have not reciprocated or performed a partial payment as contracted at the time of the revocation. In all other cases return delivery is free of charge for you. Non transportable things will be picked up at your place.  Obligations to refund payments must be met within 30 days. The deadline shall commence for you on the date you sent the notice of withdrawal and for us, following its receipt.

Dealings on credit

If you have financed the contract with a loan, and if you revoke the contract that has been financed, then you will no longer be bound to the loan agreement provided both contracts form a single economic unit. This shall be assumed in particular if we are at the same time the lender for the you or if the lender makes use of the cooperation of us with regard to financing. If we have already received the loan when the cancellation or the return becomes effective, the lender shall assume the rights and obligations of us in relation to you with regard to the legal consequences of the cancellation or return. The latter does not apply if the present contract contents buying financial instruments (such as securities, foreign currencies or derivatives). If you want to avoid a commitment to a contract as far as possible, you should withdraw both contractual statements separately.
